01. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of ticlaspalmas.com (the "Site") and the services offered by Dugal Ruby Adventures LLC ("Dugal Ruby Adventures", "we", "us" or "our"), located at 149 W 200 S, Burley, ID 83318, USA. By using the Site or submitting a request, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

02. Our Services

Dugal Ruby Adventures plans and organizes outdoor and active-travel experiences, including mountain trekking and hiking, water adventures (such as rafting, kayaking, surfing, diving and sailing), extreme sports (such as paragliding, zip-line, bungee jumping, skiing, snowboarding and off-road/ATV rides), group sports events, camping and outdoor festivals, as well as outdoor equipment rental.

Some activities are delivered by independent, licensed third-party operators (guides, outfitters, venues, transport companies or event organizers). Descriptions, photos and examples on the Site are for general information and inspiration; exact routes, schedules and inclusions are confirmed individually in your written quote.

03. Eligibility

You must be at least 18 years old to submit a request or make a booking. Minors may participate in suitable activities only with the consent and, where required, supervision of a parent or legal guardian. Certain activities have minimum age, weight, health or experience requirements, which will be communicated before booking.

04. Requests, Quotes & Bookings

• Submitting the form on the Site is a request for information only and does not create a booking or a binding contract.
• After reviewing your request, we will send you a personalized quote describing the activity, dates, price, inclusions and applicable conditions.
• A booking is confirmed only when you accept the quote in writing and we send you a booking confirmation (and, where applicable, after the agreed deposit is received).
• Availability depends on season, weather, operator capacity and permits, and is not guaranteed until confirmed.

05. Prices & Payment

All prices are quoted in U.S. dollars unless stated otherwise. The final price, what it includes (for example, guiding, equipment, transport, permits or tickets) and any taxes or fees are shown in your written quote before you commit. Payment methods and deadlines are specified in the booking confirmation. We do not collect payment card details through the forms on this Site.

06. Cancellations, Changes & Refunds

The specific cancellation and refund terms for your trip are stated in your quote and booking confirmation and prevail over this general section. Unless otherwise stated:

• Cancellation by you — cancellations made 14 or more days before the activity are eligible for a full refund minus any non-refundable third-party costs disclosed in advance; cancellations made 7–13 days before are eligible for a 50% refund; cancellations made less than 7 days before, or no-shows, are generally non-refundable.
• Changes — we will try to accommodate date or group-size changes subject to availability; price differences may apply.
• Cancellation by us — if we must cancel due to unsafe weather or conditions, operator unavailability or other circumstances beyond our control, we will offer an alternative date or activity or a full refund of amounts paid to us.

Refunds are issued to the original payment method, typically within 10 business days.

07. Participant Responsibilities & Safety

For your safety and the safety of others, each participant agrees to:

• Provide accurate information about age, health, fitness and experience level;
• Follow all instructions, safety briefings and decisions of guides and instructors;
• Use the protective equipment provided or required for the activity;
• Not participate under the influence of alcohol or drugs;
• Sign any activity-specific waiver or release required by us or our partners before participating.

Guides and instructors may refuse or end participation for anyone whose behavior or condition creates a risk, without a refund.

08. Assumption of Risk

By participating, you acknowledge these risks and voluntarily accept them to the fullest extent permitted by law. We strongly recommend that you obtain appropriate travel and medical insurance that covers the activities you book.

09. Equipment Rental

Rented equipment remains our property or the property of our partners. You agree to inspect it upon receipt, use it only for its intended purpose, return it on time and in the same condition, reasonable wear excepted. You may be charged for late returns, loss or damage beyond normal wear as described in your rental agreement. A refundable security deposit or valid ID may be required.

10. Third-Party Providers

When an activity is provided by an independent operator, that operator is responsible for delivering the activity and may apply its own terms, waivers and safety rules. We select partners carefully, but to the extent permitted by law we are not liable for the acts or omissions of independent third parties.

11. Acceptable Use of the Site

You agree not to:

• Submit false, misleading or someone else's information;
• Use the Site for unlawful purposes or to send spam or unsolicited messages;
• Attempt to gain unauthorized access to the Site, its servers or data;
• Use bots, scrapers or automated means to access the Site or submit forms;
• Interfere with the security or proper functioning of the Site.

12. Intellectual Property

All content on the Site — including text, logos, graphics, layout and code — is owned by or licensed to Dugal Ruby Adventures LLC and is protected by U.S. and international intellectual property laws. Some photographs are used under license from stock image providers. You may view and print pages for personal, non-commercial use only; any other use requires our prior written permission.

13. Disclaimers

The Site and its content are provided "as is" and "as available". While we strive to keep information accurate and up to date, we do not warrant that the Site will be error-free or uninterrupted, or that descriptions, availability or example pricing are complete or current at all times. Testimonials reflect the individual experiences of guests and do not guarantee that you will have the same experience.

14. Limitation of Liability

To the fullest extent permitted by law, Dugal Ruby Adventures LLC, its members, employees and partners will not be liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of the Site or the Services. Our total liability for any claim relating to a booking will not exceed the amount you paid to us for that booking. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence or willful misconduct.

15. Indemnification

You agree to indemnify and hold harmless Dugal Ruby Adventures LLC and its members, employees and partners from any claims, losses or expenses (including reasonable attorneys' fees) arising from your breach of these Terms, your violation of any law, or your failure to follow safety instructions.

16. Governing Law & Disputes

These Terms are governed by the laws of the State of Idaho, without regard to its conflict-of-law rules. Any dispute will first be addressed through good-faith negotiation by contacting us. If it cannot be resolved informally, it shall be brought exclusively in the state or federal courts located in Cassia County, Idaho, and you consent to the jurisdiction of those courts.

17. Changes to These Terms

We may update these Terms from time to time. The "Last updated" date shows the latest revision. Changes apply from the date they are posted and do not affect bookings already confirmed under previous terms. Please review this page periodically.
